Terms of Service

1. What ClearSkys provides

ClearSkys is a stargazing forecast tool. It combines weather data, astronomical calculations, and other inputs to produce a score and a plain-language verdict indicating how suitable conditions are for stargazing at a given location and time.

The Service is provided for informational and recreational purposes only. Forecasts are predictions, not guarantees. Weather and sky conditions can change rapidly and may differ from what the Service shows.

2. No warranty on forecast accuracy

We work to keep forecasts as accurate as possible, but we cannot guarantee their correctness, completeness, or timeliness. The Service relies on third-party weather and space-weather data sources that may be delayed, incomplete, or temporarily unavailable.

You should not rely on the Service for any decision where inaccurate information could cause harm, loss, or danger — for example travel, navigation, safety, or commercial decisions. Always use your own judgement and check local conditions before heading out.

3. Accounts

Some features — such as saving locations, push notifications, and email digests — require an account. You can create an account using an email address and password, or by signing in with a third-party provider such as Google. You are responsible for keeping your account credentials secure and for activity that occurs under your account.

You must provide accurate information when creating an account and must be old enough to form a binding agreement in your jurisdiction. You may delete your account at any time.

4. Acceptable use

You agree not to:

• use the Service in any way that breaks applicable laws or regulations;
• attempt to gain unauthorised access to the Service, its servers, or related systems;
• interfere with or disrupt the Service, including by automated scraping, excessive requests, or attempts to bypass rate limits;
• misuse, resell, or redistribute forecast data or content without permission;
• upload or transmit malicious code or content.

5. Notifications and emails

If you enable push notifications or email digests, you consent to receive those messages. You can change or disable them at any time from your account preferences. Transactional messages necessary for the operation of your account may still be sent.

6. Intellectual property

The Service — including its design, code, scoring methodology, written guides, and branding — is owned by ClearSkys and protected by applicable intellectual property laws. Underlying weather and astronomical data belongs to its respective providers. You may use the Service for your own personal, non-commercial stargazing purposes.

7. Third-party data and services

The Service incorporates data and services from third parties, including weather providers and space-weather sources. Their data is provided subject to their own terms, and we are not responsible for its accuracy or availability. Authentication via third-party providers such as Google is subject to that provider's own terms and privacy policy.

8. Availability and changes

The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these terms from time to time; the "last updated" date above reflects the most recent change. Continued use after changes means you accept the revised terms.

9. Limitation of liability

To the fullest extent permitted by law, ClearSkys shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Service — including any loss resulting from reliance on a forecast. Your use of the Service is at your own risk.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect and how we use it.
